E. Ashurst Dr., Ste. 101, Phoenix, AZ, was suspended for 60 days and placed on probation for
one year upon reinstatement. The terms of probation are participating in the State Bar’s
Member Assistance Program. He was also
assessed the costs and expenses of the disciplinary proceedings.
Mr. Urbano represented a client in a domestic relations and criminal matter. During the
course of representation, Mr. Urbano engaged
in a conflict of interest by having continuous
contact with the client’s wife without the
client’s knowledge or consent. The contact consisted of visiting her workplace, numerous telephone calls and text messages, lunch and at least
one instance of physical contact. When the wife
retained her own counsel, Mr. Urbano continued having contact with her and discussed
pending actions without the knowledge or consent of her attorney. Mr. Urbano failed to immediately inform his client, the wife’s attorney or
the court about the repeated contact. Upon
admitting his unethical actions to all parties, he
withdrew from representation and self reported
to the State Bar.
Two aggravating factors were found: dishonest or selfish motive and pattern of misconduct.
Three mitigating factors were found:
absence of prior discipline, good-faith effort to
rectify consequences of misconduct and full and
free disclosure.
Mr. Urbano violated Rule 42, ARIZ.R.S.CT.,
ERs 1. 4, 1. 7, 4. 2, 8. 4(c) and (d).
