Google and Apple: Mavericks
or Monopolists?
Is antitrust enforcement helping or hurting
innovation in e-commerce?
WEDNESDAY
When the Sherman Act was passed in 1890, Congress certainly did
not have a tablet e-reader or Internet search engine in mind. Today,
allegations of anticompetitive behavior, including monopolization,
price-fixing, and patent misuse, are being used as swords against
household names of the online world. How are 19th century common
law concepts being applied to 21st century technology? Are such
enforcement efforts benefitting consumers or deterring innovation?
Recent enforcement activities include the Federal Trade Commission’s
monopolization and patent misuse investigations of Google, the
Department of Justice’s e-book price-fixing investigation of Apple
and book publishers, as well as both governmental and private plaintiff suits concerning non-practicing entities, standards essential
patent licenses, and cybersquatting and generic top level domain
name issues.

law intersect with discovery and disclosure rules? What
