based on telephone encounters between a
records clerk and Mr. Ziman. When the records
clerk told Mr. Ziman to call back to talk with
another employee who was out of the office,
Mr. Ziman said he was getting so excited think-
ing about doing so that he “just came all over
[him]self.” When he called back the next day,
he identified himself as “Maurie Seiman.”

In finding that Mr. Ziman engaged in the
misconduct, the hearing panel said:
Individuals have an absolute freedom to
hold any number of views. Respondent
clearly holds other[s] in extreme low
regard that he deems inconvenience him.
… While in his private life he may be as
rude, offensive and demeaning as he
chooses, in his professional life he may not
hide behind his First Amendment rights to
ignore his sworn responsibilities.
Aggravating factors: prior disciplinary
offenses; dishonest or selfish motive; pattern of
misconduct; multiple offenses; refusal to
acknowledge wrongful nature of conduct; substantial experience in the practice of law; and
vulnerability of the disabled client.
Mitigating factor: full and free disclosure to
disciplinary tribunal.
By order dated Jan. 3, 2013, the Supreme
Court also granted judgment against Mr.
Ziman for the costs and expenses of the disciplinary proceeding in the amount of $6,303.71.
