Estate Planning in
the Digital Age
A new type of property has emerged that
is labeled as “digital assets.” This includes
email accounts, professional and personal
data backups, banking, investment, and
shopping accounts, domain names and
web-hosting accounts, social media, and
avatars for online games. While estate planners have developed techniques to transfer
traditional types of property, many estate
planners do not address digital assets when
preparing their clients’ estate plans. This
seminar will examine the importance of
planning for the disposition of digital assets,
examine current legal developments dealing
with digital assets, provide planning techniques, and discuss how to administer an
estate containing digital assets. In addition,
other unique technology opportunities
for the estate planner will be addressed,
including useful “apps” and other electronic
resources. Finally, the effect of the new
American Taxpayer Relief Act of 2012 on
the estate planning world will be discussed.
