Constitutional Policy
and Legislation in the
Era of Initiative

AWARD
The initiative process enables citizens to propose and enact statutes
or constitutional amendments. Because this form of ballot measure
serves as an alternative to the enactments of elected representatives,
and sometimes as a direct check on legislatures, it has found increasing support across the political spectrum as a necessary component
of our system of checks and balances. In practice, however, heated
debate has arisen over the constitutional and statutory framework
for the initiative process and judicial review of such things as the
signature-gathering process, eligibility of petition circulators, the
role of the Secretary of State and other elections officials, and the
Arizona Constitution’s “separate amendment rule” for constitutional
amendments.
What are the appropriate circumstances for an initiative? What limits,
if any, are placed on the use of initiatives? Do they help or hinder the
political and/or democratic process? What is the court’s role in super-
vising initiatives? In this interactive, case study-focused program,
designed to encourage discussion on matters of public importance,
attendees will hear from a panel of authorities on topics including:
• Initiative process for legislation and constitutional amendment
• Separate amendment rule and judicial review
• Recent legal challenges involving Propositions 121 and 204
