Important Cross-Over Issues
for Personal Injury Attorneys
Workers’ Compensation Liens, Subrogation,
and Election of Remedies
THURSDAY
This program will provide an in-depth discussion of workers’
compensation lien law for the personal-injury practitioner and
workers’ compensation lawyer, including a current analysis of the
various statutory and contractual liens in Arizona, and a discussion of how they apply to the settlement of claims and possible
pitfalls that may occur. In addition, the program will focus on
election of remedies that will assist attorneys in making the
appropriate decision on whether there is an opportunity to file in
tort rather than subject their client to the workers’ compensation
system, and which cause of action to choose. The program will
also provide practice tips for maximizing benefits and avoiding
pitfalls that could result in forfeiture of workers’ compensation
benefits.
