Frye or Daubert, that is the question!
Daubert is our new standard intended to
exclude junk science by allowing more
judicial control over who testifies. But
Daubert comes with back doors and loopholes, begging the question: Is it really a
change?
And, the problem remains of how to cross-examine an expert, who with dripping
humility declares,
“I am not God,”
and then conveys
“– but I do speak for Him!”
This dynamic presentation will address
such situations and include movie clips
and excerpts from actual successful expert
cross examinations. You will learn how to
wrestle with an expert and if not “win” at
least hold your own.

Consumer
Protections Under
the Servicemembers
Civil Relief Act
This program will explore consumer protections available to military personnel under
the SCRA. The program will review three
consumer issues commonly faced by
members of the military (debt collection,
foreclosures, and yo-yo sales) and how the
SCRA provides protections for active-duty
service members. The program will also
address how to document and obtain
attorney’s fees when handling cases under
the SCRA.
