3 Appointments Committee (continued from
10/24/13):
3President Cunningham stated the Governor’s
request for additional nominations to the
judicial nominating commissions was tabled
yesterday and moved to this meeting.
3 The discussion continued, which would
require the Appointments Committee to readvertise and vet additional candidates prior
to the December 13 meeting of the board.
3A reminder that Jeffrey Willis and James
Penny, current Board members, were nominated to the Governor prior to their being
elected to the Board of Governors. Under
the current board policy their names will
need to be removed from consideration as
sitting board members if the board votes to
provide additional nominations. It was the
General Counsel’s opinion that if the two
board members were appointed by the
Governor from the original nomination list,
they would be allowed to serve because at
the time of nomination they were not board
members.
3 From BoG Appointments Process Guidelines:
“ 4. To avoid the appearance of impropriety,
members of the Board of Governors will not
be appointed to any commission or committee unless the Supreme Court so dictates,
except that one of the ABA Delegates should
be a member of the Board of Governors.”
After discussion,
3MOTION: Mike Baumstark moved and Dee-Dee Samet seconded the motion to augment
the list of names that had been submitted
to the Governor. The vote was 9–9 with the
president breaking the tie and voting in favor
of the motion. Jeff Willis, Sam Saks and Jim
Penny abstained from the vote.
3 Consent Agenda
3President Cunningham asked if there was
anything that should come off the Consent
Agenda. Hearing nothing, the board voted
unanimously to approve the items as submitted as follows: (a) Sept. 27, 2013, Board of
Governors Meeting Minutes; Reinstatements:
(b) ( 1) Members Suspended for Non-Compliance with Annual Membership dues
and/or Trust Account Compliance (Rule
32(c)( 10) and/or Rule 43, ARIZ.R.S.CT.);
( 2) Reinstatement to Practice of Members
Suspended for Non-compliance with MCLE
Requirements (Rule 45, ARIZ.R.S.CT.); (c)
Proposed Amendments to the SBA Bylaws;
(d) Rules Committee Petition to Adopt Rule
9. 1, R. Proc. For Eviction Actions (change of
judge as a matter of right and for cause).
