Decedent’s daughter alleged that the defen-
dant semi-tractor driver fell asleep and drove
head-on into her father, who was operating
a motorcycle (Schwenk v. CTI, Inc., Pima Co.

DeRose).
Disability Discrimination
Settlement: $57,500
EEOC brought this action against a home
health care company for disability discrimination contending that defendant failed to
accommodate a hearing-impaired job applicant with a professional interpreter (EEOC v.
Creative Networks, LLC, U.S.D.C., D. Ariz.,

Plaintiff claimed that defendant health insurer
failed to provide pain medication coverage to
insured for chronic pain due to osteoarthritis,

Cervical/Lumbar Strains
Verdict: $22,000
Defendant admitted liability but disputed
the amount of damages. Arbitrator awarded
$38,500; jury awarded $22,000 (Gonzales v.
Holley, Pima Co. Super. Ct., Defense attorney:
Lori A. Petersen).
Parking Lot Accident
Verdict: $15,000
Plaintiff alleged that defendant drove her vehi-
cle 30 mph to 40 mph in a parking lot prior
to colliding with plaintiff’s vehicle (Bereckis v.
Pozdol, Maricopa Co. Super. Ct., Plaintiff
