n Nursing Home Negligence
Verdict: $1,060,000
A long-term nursing facility resident allegedly died due to
a pulmonary embolism following a total right-knee replacement due to negligent rehabilitative care provided by defendant (Apodaca v. Tucson Mather Plaza LLC, Pima Co.
Super. Ct., Plaintiff attorney: Lisa M. Kimmel).
n Sleeping Trucker Hit
Verdict: $1,105,333
Motorist struck a parked truck; sleeping trucker sustained
injuries to his shoulder and right arm (Ellis v. Chavez,
Maricopa Co. Super. Ct., Plaintiff attorney: Arthur E.
Lloyd).
n Wrongful Death
Verdict: $1,525,000
Jury awarded $200,000 to each of six children and
$325,000 to widow of decedent against several defendant
doctors and hospital (Markham v. Cook, Maricopa Co. Super.
Ct., Plaintiff attorney: Anthony J. Palumbo).
n Hunting Accident
Verdict: $28,000
Dove hunter negligently discharged rifle and struck hunting
companion with more than 13 birdshot pellets throughout his body and face (Darr v. Quesada, Pima Co. Super.
Ct., Plaintiff attorney: James B. Penny).
n Age Discrimination
Settlement: $138,000
EEOC claimed that defendant school district promulgated
and used a facially discriminatory Employee Early Retirement
Plan that accorded greater benefits to younger employees
based on age (EEOC v. Murphy School District No. 21,
U.S.D.C., D. Ariz., Plaintiff attorney: Mary Jo O’Neill).
n Defamation
Verdict: $3,443,739
Counter-defendant was accused of posting false and defamatory statements about the prevailing parties on sex-offender
websites and for abusing the process by filing lawsuits
against them (Rodrick v. Ellis, Maricopa Co. Super. Ct.,
